AAC Board (“the App”) is operated by J Honegger (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of the App. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian to create an account and use the App.

2. Your Account

• You are responsible for maintaining the confidentiality of your password, PIN, and login token(s), and for all activity under your account.
• You will not share your account or permit simultaneous logins on multiple devices except as permitted by your plan.
• You can request account deletion by contacting us at jme.dev.apps@gmail.com or use the delete account within the app.

3. Acceptable Use

You agree not to:

• Upload, post, or transmit content that is illegal, harmful, harassing, or infringes any third‑party rights (including copyrights and trademarks).
• Attempt to access the App or related systems without authorization, probe or scan for vulnerabilities, or disrupt service integrity or performance.
• Use the App for commercial provision to third parties without our prior written consent.

4. User Content & License

• Ownership: You retain ownership of the boards, tiles, and media you create or upload.
• Limited License to Us: You grant us a limited, non‑exclusive license to store, process, and display your content solely to operate the App and provide features to you (e.g., sync across your devices).
• Backups: We are not a data‑backup service. Please export/download your boards periodically.

5. Service Availability; Changes

We strive for high availability but do not guarantee uninterrupted or error‑free operation. We may modify, suspend, or discontinue features or the App (in whole or in part) for maintenance, updates, or technical reasons.

6. Subscriptions & Payments (If Applicable)

• Some features may require a paid subscription. Pricing, renewal, and cancellation terms will be presented at checkout.
• Subscriptions renew as stated at purchase unless canceled per the provided instructions. Failure to pay may result in suspension or termination of paid features.

7. Termination

• We may suspend or terminate your access if we reasonably believe you violated these Terms, pose a risk, or misuse the App.
• Upon termination, your right to use the App ceases, and you may lose access to your content stored in the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top will reflect the latest version. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
